SpacePaper Terms of Use

These Terms of Use ("Terms") govern your use of the SpacePaper app and its related services (the "Service"), provided by SpacePaper ("we", "us"). By downloading or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

These Terms supplement Apple's Licensed Application End User License Agreement (the "Apple EULA"). If these Terms conflict with the Apple EULA, these Terms apply to the extent permitted.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under the age of majority where you live, you must have permission from a parent or guardian.

2. The Service

SpacePaper offers a gallery of wallpapers and Live Photo wallpapers, tools for turning videos into Live Photos, and Collections for storing and sharing your own wallpapers. We may add, change or remove features at any time. Some features may not be available in every region or on every device.

Many wallpapers in the gallery are created with the help of artificial intelligence tools.

3. Your Account

You can use much of the Service without an account. Some features, such as Collections, sharing and bookmarks, require Sign in with Apple. You are responsible for activity on your account.

You can delete your account in the app at any time. Deletion takes effect after a 15-day restoration period, during which you can restore your account by signing in again. Signing out, switching or deleting your account does not move or remove your credits, unlocked wallpapers or Pro status (see Section 4).

4. Credits, Unlocked Wallpapers and Pro

Credits. Credits are a limited license to unlock wallpapers in the Service. One credit unlocks one wallpaper. After you unlock a wallpaper, you can download it or set it as your wallpaper again without spending another credit. Credits do not expire while the Service is operated. Credits have no cash value, cannot be exchanged for money, and cannot be sold or transferred, except as described in this Section.

Credits belong to your device, not your account. Your credits, unlocked wallpapers and wallpapers claimed for free are associated with an identifier stored on your device (see our Privacy Policy). They can be kept when you reinstall the app or restore your device from a backup, but they are not synced through your account. If you lose your device or erase it without a backup, you may lose your credits and unlocked wallpapers, and we may not be able to restore them. Your credits can be active on only one device at a time; you can switch them to another device from within the app.

Pro. Pro is a one-time In-App Purchase that unlocks the Pro tools described in the app. "Lifetime" means for as long as we operate the Service, not for your lifetime. Pro can be restored on your other devices signed in to the same Apple Account. Pro tools do not spend credits, and Pro does not include free access to the wallpaper gallery. The first purchase of Pro includes a one-time bonus of 15 credits, which is not given again when Pro is restored or purchased again on the same purchase.

Free trial. You may be offered a free 72-hour trial of Pro tools on your device. The trial is free and never converts into a paid purchase.

Today's wallpaper. We may offer a wallpaper that you can claim for free. Free offers are at our discretion and may change or end at any time.

Payment and refunds. All purchases are processed by Apple and are subject to Apple's terms. We do not process payments and cannot issue refunds ourselves; refund requests are handled by Apple. If Apple refunds a purchase, we may remove what that purchase provided.

Errors. If credits or unlocked wallpapers are delivered by mistake or obtained through error, fraud or abuse, we may correct or remove them.

5. Gallery Content

All wallpapers and other content we provide in the Service ("Gallery Content") are owned by us or our licensors. Unlocking or downloading a wallpaper does not transfer any ownership. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use Gallery Content as a wallpaper on your own devices.

You may not, without our written permission:

  • sell, sublicense, redistribute or publicly share Gallery Content, including in other apps, websites or wallpaper collections;
  • use Gallery Content for commercial purposes;
  • use Gallery Content to train or improve artificial intelligence or machine learning models;
  • remove any notices or labels from Gallery Content.

6. Your Content

Ownership. You keep all rights to the photos, videos and other content you upload to Collections or share through the Service ("Your Content").

License to us. You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit and display Your Content only as needed to operate and provide the Service to you and to the people you share it with. This license ends when Your Content is deleted from our servers, except for copies others have already saved through your share links, and for backups that are deleted in the normal course.

Sharing. When you share an item through a link, recipients can save a copy to their own Collections. Turning off sharing stops the link from working but may not remove copies that recipients have already saved.

Your responsibilities. You confirm that you own or have the rights to Your Content and to any video you import from a link, and that using it in the Service does not violate any law or the rights of others. When you import from a link, you are also responsible for complying with the terms of the website you import from. We do not review or host the videos you import from links.

Prohibited content. You may not upload, import or share content that:

  • infringes anyone's copyright, trademark, privacy or other rights;
  • is illegal, sexually explicit, involves minors in any inappropriate way, or promotes violence, hatred or discrimination;
  • harasses, threatens or impersonates others;
  • contains malware or is intended to disrupt the Service.

We may remove Your Content, disable share links or suspend accounts that violate these Terms.

7. Acceptable Use

You agree not to:

  • copy, modify, reverse engineer or attempt to extract the source code of the app, except where the law permits;
  • access the Service through automated means, or interfere with or bypass its security, request verification or purchase checks;
  • manipulate credits, purchases or free offers, or use multiple devices or identifiers to abuse them;
  • use the Service in violation of any applicable law.

8. Reporting and Copyright Complaints

To report a wallpaper, shared content or a user, or to send a copyright complaint, contact us at [email protected]. Copyright complaints should include: identification of the work, the location of the material in the Service, your contact details, a statement of good-faith belief that the use is not authorized, a statement that the information is accurate, and your signature. We may remove the material and, where appropriate, terminate repeat infringers' accounts.

9. Changes and Termination

We may modify or discontinue the Service, in whole or in part, at any time. If we discontinue the Service, we will try to give reasonable notice where practical. You may stop using the Service at any time. We may suspend or end your access if you violate these Terms.

10. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

In particular, whether a Live Photo animates on your Lock Screen depends on iOS, your device and the content, and some features (such as AI Upscale) require specific devices. We do not guarantee that the Service will be uninterrupted, error-free, or available in every region.

11. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us through In-App Purchases in the 12 months before the claim.

Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer under mandatory law in your country.

12. Apple

These Terms are between you and SpacePaper, not Apple. Apple is not responsible for the Service or its content, and has no obligation to provide maintenance or support. To the extent permitted by law, Apple has no warranty obligation for the Service, and is not responsible for any claims relating to the Service, including product liability, legal compliance or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Your Rights as a Consumer

If you are a consumer, nothing in these Terms takes away the protection you have under the mandatory laws of the country where you live, and you may bring claims in the courts of your place of residence.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email (if you have signed in and we have your email address) and by updating the effective date above. If you continue to use the Service after changes take effect, you accept the updated Terms.
